Transcription:Essex Ss. August 31 1769 I attacht a cher as the Estat of Solomon Dodge within Named and left a Summons at his Place of aboad. William Dodge Deputy Sheriff And the said Solomon comes & defends &c & saith that he is not guilty in Manner & Form a the Plt. complains against him, & thereof puts &c. Benj. Kent & the Plt by his said next Friend on the Deft. agreeing that at the Superiour Court this Demurrer may be waived & the Issue tendered joined says the Defts. Plea is bad & insufficient in Law & that he is not bound to reply thereto & for want of a good Plea prays Judgment.for his Damages & Costs. J. Lowell & the Deft. agreeing as a foresaid says his Plea is good & for Want of a proper Replication prays Judgment for his Costs. Benj. Kent
